MAGIFY - TERMS & CONDITIONS

1. Introduction

Magify is a digital media platform owned and operated by PBJ Media (“PBJ Media,†“we,†“us,†or “ourâ€). Magify enables users (“you†or “yourâ€) to receive AI-generated or enhanced images (“Magified Imagesâ€) created as part of an event, venue, brand activation, or similar experience facilitated by a participating business or establishment (“Participating Businessâ€).

By accessing or using Magify, you agree to be bound by these Terms & Conditions and our Privacy Policy.

2. Nature of the Service

Magify provides:

• Digital image processing and delivery
• A secure link to view or download your Magified Image
• Limited transactional communications related to image delivery

Magify does not operate as a marketing platform for Participating Businesses and does not control, manage, or send their independent marketing campaigns.

3. Eligibility

By using Magify, you confirm that:

• You are at least 18 years old, or have legal parental/guardian consent
• You are providing accurate contact information
• You are authorized to receive electronic communications at the contact details provided

4. User Consent

By using Magify, you:

• Consent to the processing of your image and related data to generate and deliver your Magified Image
• Acknowledge and agree to Magify's Privacy Policy
• Understand that marketing communications from Participating Businesses are separate from Magify and subject to their own policies and compliance obligations

Marketing consent is optional and not required to receive your image.

5. Communications

Magify may send transactional electronic communications (such as SMS, WhatsApp, or email) solely for the purpose of delivering your Magified Image or providing essential service information.

You may opt out of non-essential communications at any time. Transactional messages necessary to deliver requested content may still be sent where legally permitted.

6. Intellectual Property

All Magify platform software, branding, logos, and system components are the exclusive property of PBJ Media.

Your Magified Image may be subject to:

• Usage rights granted by the Participating Business
• Event-specific terms or releases
• Applicable intellectual property laws

Unless otherwise stated, Magify grants you a personal, non-commercial license to view, download, and share your image.

7. Prohibited Use

You agree not to:

• Use Magify for unlawful purposes
• Interfere with platform functionality
• Attempt unauthorized access to systems or data
• Misuse or redistribute content in violation of applicable rights

8. Disclaimers

Magify is provided “as is” and “as available.” PBJ Media makes no warranties regarding uninterrupted availability, image suitability for a particular purpose, or third-party services.

9. Limitation of Liability

To the maximum extent permitted by law, PBJ Media shall not be liable for indirect, incidental, or consequential damages arising from use of Magify.

10. Governing Law

These Terms are governed by the laws of Jamaica, without prejudice to mandatory consumer protections applicable in your jurisdiction.

11. Changes

We may update these Terms periodically. Continued use of Magify constitutes acceptance of any revised Terms.

MAGIFY - PRIVACY POLICY

1. Overview

This Privacy Policy explains how PBJ Media collects, uses, stores, and protects personal data through Magify, in compliance with:

• Jamaica Data Protection Act (2020)
• GDPR (EU & UK)
• U.S. privacy laws (including CCPA/CPRA where applicable)
• Canada's CASL
• Twilio messaging policies

2. Data We Collect

We may collect:

• Contact information (phone number, email address)
• Images submitted or captured through Magify
• Technical metadata (IP address, device type, timestamps)
• Consent and interaction logs

We do not knowingly collect sensitive personal data unless explicitly required for service delivery.

3. How We Use Data

Your data is used to:

• Generate and deliver your Magified Image
• Send transactional communications related to your request
• Improve system performance and reliability
• Maintain compliance, security, and audit records

4. Marketing Communications

Magify does not conduct third-party marketing campaigns.

If you consent to marketing communications from a Participating Business:

• That business acts as an independent data controller
• Their communications are governed by their own privacy and compliance obligations
• You may opt out directly through them

5. Data Sharing

PBJ Media:

• Does not sell, trade, or rent personal data
• Does not provide personal data to unrelated third parties
• May share limited data with trusted service providers (e.g., cloud hosting, messaging delivery) strictly for service operation

All service providers are contractually required to protect data.

6. International Transfers

Data may be processed or stored in jurisdictions outside your country of residence. Where applicable, appropriate safeguards are used to ensure lawful cross-border transfers.

7. Data Retention & Image Handling

Personal data is retained only for as long as necessary to:

• Generate and deliver your Magified image
• Meet legal, operational, or compliance requirements
• Resolve disputes or enforce agreements

Selfie Images: Selfie images submitted or captured for the purpose of creating a Magified image are processed transiently and are destroyed shortly after image generation. These selfie images are not stored, shared, used, or distributed for any other purpose.

Magified Images: The final Magified image is stored securely on PBJ Media’s servers for the purpose of delivery, viewing, and limited retention. PBJ Media does not independently use, sell, distribute, or share Magified images.

A Magified image may be shared with a participating business, establishment, or event client only where you have explicitly consented to receive marketing or informational communications from that specific entity. Any such sharing is limited to the scope of your consent and is governed by that entity’s own privacy policies and legal obligations.

Images and access links may expire automatically after a defined period, after which they may be permanently deleted.

8. Your Rights

Depending on your jurisdiction, you may have the right to:

• Access your personal data
• Request correction or deletion
• Withdraw consent
• Object to processing
• Request data portability
• Lodge a complaint with a data protection authority

9. Security

We implement reasonable technical and organizational safeguards to protect personal data. However, no system is 100% secure.

10. Children's Privacy

Magify is not intended for children under 13 without parental consent. Images involving minors are subject to event-specific permissions and releases.

We may update this Privacy Policy periodically. Updates will be reflected by the Last Updated date.
